Recent Changes to Legislation

What the NSW strata reforms mean for unit entitlements — and who is legally allowed to value them.

1 March 2016

Valuers Registration in NSW

On 1 March 2016, the NSW Valuers Act 2003 was repealed.

Since that date, there is no such term as a Registered Valuer in NSW. The term ‘Qualified Valuer’ is used in the new strata legislation (as well as the Land Acquisition (Just Terms Compensation) Act 1991) and refers to an Associate, Fellow or Life Fellow of the Australian Property Institute and excludes a Student or Provisional member. (A member of the Australian Valuers Institute must be a Fellow or Life Fellow and excludes an Associate or Student member of that institute; and a member of the Royal Institution of Chartered Surveyors must be a Chartered Valuer member). That is, only the above prescribed members of the above bodies can carry out unit entitlement valuations.

Wal Dobrow is a Fellow of the Australian Property Institute and is a Qualified Valuer that can carry out Valuations for Unit Entitlements, and provide Valuer’s Certificates for the registration of Strata and Community Title Plans.

30 November 2016

New Strata Legislation in NSW

On 30 November 2016, the following Strata legislation was enacted:

  • The Strata Schemes Development Act 2015
  • The Strata Schemes Development Regulation 2016
  • The Strata Schemes Management Act 2015
  • The Strata Schemes Management Regulation 2016

The Strata Reform legislation created significant changes dealing with Unit Entitlements. These changes prohibited developers and their consultants from writing their own unit entitlements, and which now requires a ‘Qualified Valuer’ to carry out the determination of Unit Entitlements based upon Market Value as defined by the Strata Schemes Development Act 2015.

The new legislation allows a certain class of person to object to and have the Unit Entitlements reallocated if the Unit Entitlements are proven to be unreasonable and the Tribunal exercises its discretion to allow the change to the Schedule of Unit Entitlements set out in the Strata Plan.

Our Services

Strata & unit entitlement valuations

Valuer’s Certificates, Schedules of Unit Entitlement and Expert Witness Reports for developers, surveyors, owners corporations and lot owners across NSW.

01

New Strata Plans

We provide Valuer’s Certificates with a Schedule of Unit Entitlements, and a Statement of Reasoning as required by our professional standards, and the Strata Schemes Development Act 2015 — enabling your strata plan to be lodged efficiently at Land Registry Services (previously LPI) and have the property titles issued quickly.

New Strata Plans can include a development lot which requires a significant change to the method of Valuation. Very few Qualified Valuers understand these differences.

Strata Plans of Subdivision

The type of Valuer’s Certificate and the Schedule of Unit Entitlements depends upon whether Common Property or a Development Lot is affected. We provide the full range of Valuer’s Certificates in compliance with the Land Registry Services requirements.

The calculation and method of Valuation will vary depending upon whether the further strata subdivision of an existing strata plan includes Common Property, or includes a development lot, or does not involve Common Property. This is a specialised area of the Valuation Profession that we know very well.

Re-allocation of existing Unit Entitlements

We provide a cost-effective two stage solution. Firstly, we determine whether the existing Unit Entitlements are unreasonable and recommend if they should be changed (Stage 1). Then, if the Client wishes to proceed we will prepare an Expert Witness Report in accordance with the Tribunal’s Code of Conduct (Stage 2).

The re-allocation of existing Unit Entitlements can be ordered by the Tribunal (or the Supreme Court in rare cases) and the requirements under s236 of the Strata Schemes Management Act 2015 have to be met. We are experts in this area.

Questions

Strata valuation FAQs

Quick answers about Qualified Valuers, Valuer’s Certificates and unit entitlements in NSW.

Who can provide a Valuer’s Certificate for a strata plan in NSW?

Only a Qualified Valuer as defined by the NSW Strata Schemes Development Act 2015 can provide a Valuer’s Certificate with a Schedule of Unit Entitlements for the registration of a Strata or Community Plan. Strata Property’s Valuers have been Registered and Qualified Valuers since 1984.

Is there still such a thing as a Registered Valuer in NSW?

No. On 1 March 2016 the NSW Valuers Act 2003 was repealed, and since that date there is no such term as a Registered Valuer in NSW. The strata legislation uses the term ’Qualified Valuer’, which is limited to specific membership classes of the Australian Property Institute, the Australian Valuers Institute and the Royal Institution of Chartered Surveyors.

How are unit entitlements determined for a new strata plan?

Under the strata reform legislation, developers and their consultants can no longer write their own unit entitlements. A Qualified Valuer must determine the Unit Entitlements based upon Market Value as defined by the Strata Schemes Development Act 2015.

Can existing unit entitlements be changed?

Yes, in certain circumstances. The re-allocation of existing Unit Entitlements can be ordered by the Tribunal (or the Supreme Court in rare cases) where the requirements under s236 of the Strata Schemes Management Act 2015 are met. This requires an Expert with specialised knowledge to prepare an Expert Witness Valuation Report. We offer a cost-effective two-stage process: first we assess whether the existing Unit Entitlements are unreasonable, then, if you wish to proceed, we prepare the Expert Witness Report.
